These Terms and Conditions apply to all purchases made via the OMM website (https://theomm.com). By placing an order, you agree to be bound by these Terms and Conditions.

We may update these Terms from time to time. Any changes will apply to orders placed after the updated Terms are published on this page.

1. Description of Goods

We sell lightweight clothing, waterproof clothing, rucksacks, sleeping bags, and accessories designed for mountain marathons and running activities. We also sell event entries and related extras.

All product descriptions, images, and specifications are provided for illustrative purposes. We make reasonable efforts to ensure accuracy, but minor variations may occur.

2. Prices

All prices are displayed in GBP and include UK VAT where applicable.

The price payable is the price displayed at the time your order is accepted.

We reserve the right to correct pricing errors. If an error is identified after your order is placed, we will contact you and give you the option to reconfirm or cancel your order.

3. Orders and Payment

You must be at least 18 years old to place an order.

Payment is taken at the point of purchase. All payments are securely processed via Stripe.

We take reasonable precautions to protect payment information but cannot be held liable for breaches outside our control.

We reserve the right to refuse or cancel orders where fraud or unauthorised activity is suspected.

4. Delivery

We aim to dispatch orders within 5 working days. Delivery times are estimates and not guaranteed.

UK Deliveries

• Typically delivered within 1–3 working days after dispatch
• Orders over £50 include free delivery
• Orders under £50 incur a delivery charge

International Deliveries

• May take up to 5 working days or longer depending on destination
• Items are not considered lost until 14 working days after dispatch

All deliveries are sent via signed-for services (e.g. Royal Mail, UPS, Parcelforce). A signature is required on delivery.

If delivery is delayed beyond a reasonable timeframe, you will be contacted and may have the option to cancel your order.

5. Availability

All products are subject to availability. If we are unable to fulfil your order, we will notify you as soon as possible and issue a refund where applicable.

6. Returns and Refunds

Faulty or Incorrect Goods

If goods are faulty or not as described, you are entitled to a repair, replacement, or refund in accordance with your statutory rights.

We may request evidence (e.g. photographs) and/or require the item to be returned for inspection.

Non-Fault Returns

You may return items within 14 days of receipt if you change your mind, provided that:

• Items are unused and unworn
• Original packaging is intact
• Tags remain attached
• Proof of purchase is provided

Return postage is the responsibility of the customer. Refunds will be issued for the item cost only.

7. Warranty

All products are covered by your statutory rights.

Warranty claims apply to the original purchaser and require proof of purchase.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Breach of consumer rights under applicable law

To the fullest extent permitted by law, we shall not be liable for:

• Indirect or consequential losses
• Loss of profits, revenue, or business
• Delays or failures caused by events outside our reasonable control

9. Use of Products

Products are designed for outdoor and endurance activities. It is your responsibility to ensure they are used appropriately and safely. We are not liable for misuse or failure to follow product guidance.

10. Data Protection

We process personal data in accordance with applicable data protection laws, including the Data Protection Act 2018 and UK GDPR.

12. Third-Party Distribution

OMM Ltd may contract the supply of goods through authorised distributors.

13. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
